If you told him to stop and he didn’t listen then yes I would consider it assault. If that’s not the case I would have a serious conversation with him.

It's tricky in that case. But that being said, please, please communicate to him that that position specifically is a hard line for you. You can, but do not have to tell him why. If he ever even tries it again after that chat, then yeah, it's absolutely sexual assault. And if you currently no longer feel comfortable with him, you have every right to walk.
